Terms of service

These terms are the agreement between you and Drift Lullabies for using our website and service. We've kept them as plain as we can. By creating an account or using Drift, you agree to these terms and to our Privacy policy.

Who can use Drift

You must be 18 or older and able to enter a binding agreement. Accounts are for adults. You're responsible for the information you provide, including confirming you have the right to provide any name or details about a child.

What Drift is

Drift creates personalized, AI-generated lullabies from a few answers you give us. The lyrics and audio are produced by artificial intelligence. Each lullaby is a unique creative output — we can't guarantee a specific artistic result or that a song will sound a particular way, and generation is provided on a reasonable-efforts basis.

Your account

Keep your login details secure; you're responsible for activity under your account. Let us know at hello@driftlullabies.com if you think someone else has access. One account per person.

Your lullaby, and what "yours to keep" means

Your inputs. You keep whatever rights you have in the answers, names, and words you give us. You grant Drift Lullabies the permission needed to use them to create, store, and deliver your lullaby, and to run and improve the service.

Your lullaby is yours. Once your lullaby is made, it is yours to play, download, keep, and share for your personal use — forever. We grant you this broad personal-use license to the fullest extent our AI providers allow.

An honest note on ownership. Because lullabies are made by AI, they generally can't be held as copyright by anyone — not by you and not by us. That's simply how the law currently treats AI-generated audio, not a limit we chose. What you receive is a license to enjoy your lullaby freely and forever for personal use — which is exactly how you'll use it: keeping it, and sharing it with family.

Personal use. Your license is for personal, non-commercial use — playing, gifting, and sharing your lullaby with family and friends. Please don't resell the song or use it as a commercial music product.

Acceptable use

Please don't: provide unlawful, abusive, or infringing inputs; impersonate someone or use a child's identity you have no right to use; try to break, overload, scrape, or reverse-engineer the service; resell or commercially exploit generated songs; or use Drift to harm others.

Payments

Drift is currently free during our founding early-access period. When payments are enabled, prices are shown before you buy and are processed by Stripe. You're responsible for any applicable taxes. Refunds are covered by our Refund & guarantee policy.

Founding program

During founding early access, Drift may be offered free in exchange for an honest review and a share of your lullaby. Taking part is voluntary. We ask only for your honest opinion — the lullaby is yours whether your review is positive or not — and, when you share, that you let people know you received Drift free as a founding family.

A keepsake, not a clinical service

Drift is provided "as is" and "as available." Drift is a keepsake and comfort product — it is not a medical, therapeutic, or clinical service, and makes no health or sleep-outcome claims. While Drift is designed by a board-certified music therapist, it is not intended for clinical use. We don't warrant that the service will be uninterrupted or error-free, or that a lullaby will produce any particular effect.

Limitation of liability

To the maximum extent permitted by law, Drift Lullabies is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or 100 US dollars. Some places don't allow certain limitations, so some of these may not apply to you.

Termination

You can stop using Drift and delete your account at any time. We may suspend or end accounts that break these terms or the law. Any license to lullabies you've already created continues after your account ends.

Governing law

These terms are governed by the laws of the United States and of the state in which Drift Lullabies is established, without regard to conflict-of-laws rules.

Changes

We may update these terms as Drift grows. If we make a material change, we'll update the date above and, where appropriate, let you know. Continuing to use Drift after a change means you accept it.
